Acceptable Use Policy
The rules for using the swelv platform. They apply to every customer and to everyone a customer gives access to, and they form part of the Master Services Agreement.

Who this policy is with
This policy is part of the Master Services Agreement between the customer and the Swelv entity named in its Order Form. The customer is responsible for making sure everyone it gives access to, including its staff and the investors and advisers it invites, follows it.
Contracting entity
The Swelv entity that applies this policy is the one the customer contracts with, listed for where the customer is established.

Use it lawfully
Do not use the platform to break the law, or to help anyone else break it. That includes the law on financial services, fund marketing, anti-money laundering, sanctions, and data protection. In particular, do not use it to:
- facilitate fraud, money laundering, terrorist financing, or sanctions evasion;
- arrange capital calls or distributions involving a person or entity subject to sanctions; or
- market a fund, or communicate with investors, in a way the law of the relevant jurisdiction does not permit.
Payment instructions
Capital calls are a target for payment fraud, so the payment details the platform issues have to be trustworthy. Do not:
- issue false or misleading payment instructions, or instructions for an account that does not belong to the fund or the intended recipient;
- impersonate a fund, fund manager, administrator, investor, or Swelv; or
- change bank or collection account details other than through the platform’s own controls, by someone authorised to do so.
If you suspect a payment instruction is fraudulent, stop and tell us at info@swelv.io straight away. The Security page explains how to verify an instruction.
Data you put in
- Only upload data and documents you are entitled to share, and for which the controller has a lawful basis.
- Do not upload special category data or criminal offence data unless the customer has agreed in writing with Swelv how it will be handled.
- Do not upload malware, or content that is unlawful, defamatory, or infringes someone else’s rights.
Security and integrity
Do not:
- access, or try to access, any account, data, or part of the platform you are not authorised to use, including another customer’s data;
- probe, scan, or test the platform for vulnerabilities without Swelv’s prior written permission;
- bypass or interfere with access controls, rate limits, or the separation between customers;
- share login credentials, or let anyone use an account other than the person it was issued to;
- access the platform by automated means other than interfaces Swelv documents or agrees to; or
- place a load on the platform that degrades it for other customers.

Document extraction
Some features use AI models to read the documents you upload. Do not submit documents or content designed to manipulate that processing, for example to make it disclose data or instructions it should not, or to produce figures that do not reflect the source. Extracted figures are confidence scored; review them before relying on them.
The software itself
Do not copy, modify, or create derivative works of the platform; reverse engineer or decompile it, except to the extent the law allows despite this restriction; resell, sublicense, or provide it to third parties as a service; use it or its documentation to build a competing product; or remove any proprietary notice.
If this policy is breached
Swelv may suspend access, to the extent reasonably necessary, while a breach is investigated or resolved. It will give notice in advance where practical, and restore access once the issue is fixed. A serious or repeated breach may be a material breach of the Master Services Agreement.
Changes
Swelv may update this policy. Changes take effect in the same way as changes to the Master Services Agreement.
